1. Introduction & Acceptance of Terms
1.1 These Terms and Conditions (the "Terms") govern your access to and use of the website located at www.customsongsforlife.com (the "Site") and all services offered by Custom Songs For Life ("we," "us," or "our").
1.2 By visiting the Site, creating an account, placing an order, or clicking "Place Order," you ("Customer" or "you") acknowledge that you have read, understood, and agree to be legally bound by these Terms in their entirety. If you do not agree to these Terms, you must not use the Site or place an order.
1.3 You must be at least 18 years of age, or the age of majority in your jurisdiction, to place an order. By accepting these Terms, you represent and warrant that you meet this requirement. In certain EU member states, individuals aged 16 or older may enter into contracts for digital services with parental or guardian consent.
1.4 These Terms constitute a binding legal agreement between you and Custom Songs For Life. Your ability to place an order is expressly conditioned upon your acceptance of these Terms.
1.5 Electronic Contract Formation. By clicking "Place Order," checking the order confirmation checkbox, or downloading the delivered files, you form a binding electronic contract with Custom Songs For Life under the Maryland Uniform Electronic Transactions Act (MUETA), Md. Code, Com. Law § 21-101 et seq., the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001, the EU eIDAS Regulation No 910/2014, and the UK Electronic Communications Act 2000. Electronic acceptances carry the same legal force as handwritten signatures.
1.6 Right to Refuse Service. Custom Songs For Life reserves the right to refuse, cancel, or terminate any order at its sole discretion if the requested content violates these Terms, is deemed offensive, harmful, or illegal, or if the Customer has previously violated these Terms. In such cases, a full refund of any payments made will be issued promptly.
1.7 EU/UK Consumer Withdrawal Notice. Customers located in the European Union or United Kingdom normally have a 14-day right of withdrawal under the EU Consumer Rights Directive (2011/83/EU) and the UK Consumer Contracts Regulations 2013. However, this right does not apply to custom digital content where performance has begun with the customer's prior express consent and acknowledgment of the loss of that right, per Article 16(m) of the Directive and Regulation 28(1)(b) of the UK Regulations. EU/UK customers must confirm a mandatory checkbox at checkout before production commences. See the Refund Policy for full details.
2. Services Description
2.1 Custom Songs For Life provides a bespoke custom song creation service. Each song is individually composed, arranged, recorded, and produced according to the specific details, preferences, and creative brief submitted by the Customer at the time of ordering.
2.2 All songs are custom digital goods created entirely to order. Because each composition is unique and personally tailored to each Customer, no two songs are alike, and no song is produced from a pre-existing catalogue or template.
2.3 Our services are provided exclusively in digital format. No physical media, sheet music, or licensing packages are included unless expressly agreed to in a separate written agreement.
2.4 Services are available to customers worldwide. All contracts are formed under the laws of the State of Maryland, United States of America. The specific services offered, and their current standard prices, are as follows:

2.5 We reserve the right to modify, discontinue, or introduce services at any time. Prices in effect at the time an order is placed shall govern that order.
3. Order Process
3.1 To place an order, Customers must complete the order form available on the Site. This form will require you to provide the information necessary for us to create your custom song, which may include, but is not limited to:
- The occasion type and relevant details (e.g., wedding date, names of individuals);
- Names of the people the song is written about or dedicated to;
- A personal story, anecdotes, or key memories to be reflected in the song;
- Musical style, genre, mood, or tone preferences;
- Any specific words, phrases, or themes you would like included; and
- Any other details or preferences relevant to your order.
3.2 Once you have submitted your order form and completed payment, you will receive an order confirmation email to the email address provided at checkout. This confirmation constitutes our acceptance of your order and the commencement of our agreement under these Terms.
3.3 It is your sole responsibility to ensure that all information submitted in your order form is accurate, complete, and sufficient. Custom Songs For Life cannot be held responsible for unsatisfactory results arising from incomplete, inaccurate, or insufficient information provided by the Customer.
3.4 Customer Brief Accuracy Warranty. The Customer warrants that all information submitted in the creative brief — including names, personal stories, and references to third parties — is accurate, truthful, and does not infringe the privacy, publicity rights, or intellectual property rights of any third party. Custom Songs For Life bears no liability for songs created based on inaccurate or unauthorized customer-supplied information.
3.5 Third-Party Subjects. If the song references a third party (for example, a song written about another person), the Customer represents and warrants that they have obtained any necessary consent from that individual for their story and personal details to be used in a creative work.
3.6 Customer Content License. By submitting a creative brief, the Customer grants Custom Songs For Life a limited, royalty-free, worldwide license to use the submitted information solely for the purpose of creating the ordered song and, in anonymized or generalized form, for internal service improvement purposes.
3.7 We reserve the right, at our absolute discretion, to decline or cancel any order for any reason, including but not limited to the nature of the requested content. In such circumstances, a full refund of any payment made will be issued.
4. Pricing & Payment
4.1 All prices are listed in United States Dollars (USD) and are inclusive of the services described in Section 2 above. Prices are subject to change without notice, provided that the price applicable at the time your order is confirmed shall be honored for that order.
4.2 Payment is due in full at the time of placing your order. We do not offer credit, deferred payment, or payment plans unless separately agreed to in writing.
4.3 We accept the following payment methods:
- Major credit cards (Visa, Mastercard, American Express, Discover);
- Major debit cards bearing a credit card network logo; and
- PayPal.
4.4 All payments are processed securely through third-party payment processors. Custom Songs For Life does not store or have access to your full payment card details.
4.5 Taxes. Applicable sales tax, VAT, or other governmental taxes and levies may be applied to your order depending on your location and applicable law. The applicable tax amount, if any, will be displayed at checkout prior to payment confirmation.
4.6 If a payment is declined or reversed, we reserve the right to suspend or cancel your order until payment is received in full.
4.7 International Customers — Currency & Conversion. All prices are listed in USD. International customers acknowledge that currency conversion fees and exchange rate differences may apply and are solely the Customer's responsibility. Custom Songs For Life is not liable for any losses arising from currency fluctuation.
4.8 VAT / GST Notice. EU customers: prices shown are exclusive of VAT; applicable VAT will be added at checkout based on the Customer's EU member state of residence. UK customers: VAT will be added at checkout where applicable under UK law. Australian customers: GST may apply in accordance with Australian taxation law. The applicable tax amount will be displayed at checkout prior to payment confirmation.
4.9 Promotional Codes & Discounts. Promotional codes and discounts are single-use, non-transferable, cannot be combined with other offers, and have no cash value. Expired or invalid codes will not be honored.
4.10 Gift Vouchers / E-Gift Cards. Gift vouchers issued by Custom Songs For Life are non-refundable, non-transferable, and valid for 12 months from the date of issue. Lost or stolen gift vouchers cannot be replaced and cannot be exchanged for cash.
5. Delivery & Turnaround
5.1 Upon completion of your custom song, we will deliver the final audio files to the email address provided at checkout. Delivery is made exclusively in digital format.
5.2 Standard Delivery: Orders are delivered within 7–10 business days from the date of order confirmation and receipt of all required Customer information.
5.3 Express Delivery: Customers who purchase the Express Delivery Add-On (+$129.00) will receive their completed song within 3–5 business days from the date of order confirmation and receipt of all required Customer information.
5.4 Delivered files will be provided in both MP3 and WAV digital audio formats.
5.5 For the purposes of these Terms, "business days" means Monday through Friday, excluding publicly recognized United States federal holidays and any other days on which our operations are suspended.
5.6 Turnaround times begin only upon receipt of a complete and sufficient creative brief from the Customer. If we require additional information to proceed with production, the turnaround clock will pause until that information is received. Custom Songs For Life shall not be liable for any delay in delivery arising from a Customer's failure to provide required information in a timely manner.
5.7 While we strive to meet all stated turnaround times, delivery timelines are estimates and not guarantees. We will notify you promptly if a delay is anticipated.
6. Revisions Policy
6.1 Each order includes one (1) free revision at no additional charge, provided the revision request is submitted within 7 calendar days of the date on which the final song files were delivered to the Customer.
6.2 All revision requests must be submitted in writing via email to [email protected]. Verbal requests or requests submitted through any other channel may not be honored.
6.3 Scope of Revisions. The free revision covers reasonable adjustments to the existing song, including but not limited to: minor lyric changes, corrections to names or details, and adjustments to phrasing. The free revision does not include:
- A complete rewrite of the song's lyrics;
- A change in musical style, genre, tempo, or overall arrangement;
- A fundamental change in the creative direction of the song; or
- Any change that, in our reasonable professional judgment, constitutes a materially different song from what was originally requested.
6.4 If you require changes that fall outside the scope of the included free revision, we may offer additional revision services at an additional fee, to be agreed upon in writing prior to the work being undertaken.
6.5 Revision requests submitted more than 7 days after the delivery date will not be honored under the free revision entitlement, but may be accommodated at an additional fee at our discretion.
7. Intellectual Property
7.1 Ownership. Custom Songs For Life retains all intellectual property rights — including copyright — in and to each custom song, encompassing the composition, lyrics, melody, arrangement, recording, production, and any other creative elements of the delivered work.
7.2 License to Customer. Upon receipt of full payment for your order, Custom Songs For Life grants you a non-exclusive, non-transferable, personal license to use the delivered song for personal, non-commercial purposes only. This license includes the right to:
- Play the song privately for personal enjoyment;
- Share the song informally with friends and family; and
- Use the song at the specific private occasion for which it was created (e.g., playing it at a wedding reception).
7.3 Prohibited Commercial Uses. The personal license granted above expressly excludes, and you may not, without a separate written licensing agreement with Custom Songs For Life:
- Use the song for any commercial purpose or for monetary gain;
- Sell, sublicense, transfer, or assign the song or any rights therein to any third party;
- Broadcast or publicly perform the song via any medium (including radio, television, streaming platforms, or live performance venues);
- Use the song in sync licensing arrangements (e.g., in films, advertisements, or video content intended for commercial distribution);
- Upload or distribute the song on any music platform (e.g., Spotify, Apple Music, YouTube Music) for revenue-generating purposes; or
- Re-distribute the song in any form, digitally or otherwise, beyond personal sharing.
7.4 If you wish to use your custom song for any commercial, broadcast, or sync purpose, please contact us at [email protected] to discuss commercial licensing terms.
7.5 Customer Warranty. By submitting information, materials, or content as part of your order, you represent and warrant that: (a) you own or have the right to use and share all such materials; and (b) the use of such materials by Custom Songs For Life in the creation of your song will not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.
8. User Responsibilities
8.1 As a user of the Site and a Customer of our services, you agree to:
- Provide accurate, complete, and truthful information when submitting your order;
- Use the delivered song files solely in accordance with the license granted in Section 7;
- Promptly respond to any requests from us for additional information needed to complete your order;
- Keep your account credentials (where applicable) secure and confidential; and
- Not attempt to reverse-engineer, reproduce, alter, or re-record the delivered audio files beyond personal use.
8.2 You agree not to use the Site or our services for any unlawful, defamatory, harassing, harmful, fraudulent, or otherwise objectionable purpose.
8A. Indemnification
8A.1 The Customer agrees to indemnify, defend, and hold harmless Custom Songs For Life, its officers, directors, employees, artists, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) the Customer's breach of these Terms; (b) the Customer's misuse of the services or delivered files; (c) the Customer's infringement of any third-party intellectual property, privacy, or other rights; or (d) any false or inaccurate information submitted by the Customer as part of their order.
9. Prohibited Uses
9.1 You may not request, submit, or use our services to create content that:
- Contains or promotes hate speech, discrimination, or violence against any individual or group on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic;
- Is defamatory, harassing, threatening, or abusive toward any individual;
- Sexualizes, exploits, or endangers minors in any way;
- Promotes, glorifies, or facilitates any illegal activity;
- Infringes upon the intellectual property, privacy, or publicity rights of any third party;
- Contains false, misleading, or fraudulent representations; or
- Is otherwise offensive, harmful, or contrary to applicable law or public policy.
9.2 Custom Songs For Life reserves the right to refuse, cancel, or terminate any order, at its sole discretion, if it determines that the requested content violates this Section or is otherwise inappropriate. In such cases, a refund will be issued in accordance with our Refund Policy.
9A. Non-Disparagement
9A.1 The Customer agrees not to make, publish, or communicate to any person or entity any defamatory, disparaging, or derogatory remarks, comments, or statements concerning Custom Songs For Life, its artists, employees, officers, or services, whether in written, oral, or electronic form, including on social media, review platforms, or any public forum. This clause does not prevent the Customer from making truthful, good-faith complaints to regulatory or consumer protection authorities, or from exercising any statutory rights that cannot be waived under applicable law.
9B. Testimonials, Reviews & FTC Compliance
9B.1 Custom Songs For Life may display customer testimonials, reviews, and song samples on its website and marketing materials. In accordance with the US Federal Trade Commission (FTC) Guides Concerning the Use of Endorsements and Testimonials (16 C.F.R. Part 255), any material relationship between Custom Songs For Life and a reviewer (including any discount, gift, or compensation in exchange for a review) will be clearly disclosed. Testimonials reflect individual experiences and results may vary. No testimonial constitutes a guarantee of a specific artistic outcome.
9C. Web Accessibility
9C.1 Custom Songs For Life is committed to ensuring its website is accessible to all users, including those with disabilities, in accordance with the Americans with Disabilities Act (ADA), Web Content Accessibility Guidelines (WCAG 2.1 Level AA), and the European Accessibility Act (Directive 2019/882/EU). 10. Disclaimer of Warranties
10.1 Our services are provided on an "as is" and "as available" basis, without warranty of any kind, express or implied, to the fullest extent permitted by applicable law.
10.2 While Custom Songs For Life will make all reasonable professional efforts to create a high-quality, personalized song that reflects the information and preferences you have provided, we make no guarantee of any specific artistic outcome, style, or result. Musical creation is inherently subjective, and individual satisfaction may vary.
10.3 We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
11.1 To the maximum extent permitted by applicable law, Custom Songs For Life's total liability to you arising out of or in connection with any order or these Terms shall be limited to the total amount paid by you for the specific order giving rise to the claim.
11.2 Under no circumstances shall Custom Songs For Life be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, loss of goodwill, or emotional distress, even if we have been advised of the possibility of such damages.
11.3 Some jurisdictions do not allow the exclusion or limitation of certain damages. If you are a resident of such a jurisdiction, the limitations above may not fully apply to you, and your statutory rights are unaffected.
11.4 EU/UK Carve-Out. Nothing in these Terms limits or excludes Custom Songs For Life's liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under mandatory applicable law in the Customer's jurisdiction of residence.
11A. Digital Goods — Legal Classification & Delivery
11A.1 Classification as Digital Goods. The custom songs created and delivered by Custom Songs For Life are digital goods as defined under applicable Maryland commercial law and US federal statutes. Each song constitutes a unique, custom-made digital work product delivered electronically. As digital goods:
- (a) No physical product will be shipped or delivered;
- (b) Standard retail return and exchange rules applicable to physical goods do not apply;
- (c) Digital goods are subject to the custom/bespoke digital content exemption from right-of-withdrawal laws in the EU (Consumer Rights Directive Art. 16(m)) and UK (Consumer Contracts Regulations 2013, Reg. 28(1)(b)); and
- (d) Delivery is deemed complete when the digital files are transmitted to the Customer's registered email address, regardless of whether the Customer opens or reads the delivery email.
11A.2 Maryland UCC & Digital Delivery. Under Maryland's Uniform Commercial Code and MUETA principles, the electronic delivery of song files constitutes a valid and complete tender of delivery. The Customer's confirmation of receipt — or failure to notify us of non-receipt within 48 hours of the stated delivery date — creates a presumption of successful delivery.
11A.3 Federal Digital Commerce Compliance. Custom Songs For Life complies with the following US federal laws governing digital commerce:
- CAN-SPAM Act (15 U.S.C. § 7701): All commercial emails include a working unsubscribe mechanism; opt-out requests honored within 10 business days.
- Children's Online Privacy Protection Act (COPPA) (15 U.S.C. § 6501): Services are not directed at children under 13; no data is knowingly collected from minors.
- Electronic Signatures in Global and National Commerce Act (E-SIGN) (15 U.S.C. § 7001): Electronic acceptances and confirmations are legally binding.
- Digital Millennium Copyright Act (DMCA) (17 U.S.C. § 512): DMCA agent designated; takedown requests honored per statutory process.
- FTC Act (15 U.S.C. § 41 et seq.): All representations are truthful and non-deceptive; testimonials disclosed per FTC Guides (16 C.F.R. Part 255).
11A.4 International Digital Goods Delivery. For international customers, digital goods delivery via email is recognized as valid and complete electronic delivery under: the EU Electronic Commerce Directive (2000/31/EC); the UK Electronic Commerce (EC Directive) Regulations 2002; the UNCITRAL Model Law on Electronic Commerce; and applicable national e-commerce regulations in the Customer's country of residence.
11B. EU/UK Specific Consumer Rights
11B.1 EU Customers: Customers located in the European Union have rights under the EU Consumer Rights Directive (2011/83/EU). The right of withdrawal (14-day cooling-off period) does NOT apply to custom digital content where performance began with the Customer's prior express consent, per Article 16(m) of that Directive.
11B.2 UK Customers: Customers located in the United Kingdom have rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. The same custom digital goods exception applies (Regulation 28(1)(b)).
11B.3 Conformity Guarantee: If delivered files are technically defective (corrupted, wrong format, unplayable), the Customer is entitled to a remedy. See Refund Policy, Section 5 for eligible refund situations.
11B.4 EU Online Dispute Resolution: EU customers may use the EU ODR platform to resolve disputes: https://ec.europa.eu/consumers/odr. Our designated contact for ODR purposes is: [email protected].
11B.5 Nothing in these Terms limits statutory rights that cannot be waived under mandatory applicable consumer law in the Customer's country of residence.
12. Governing Law & Dispute Resolution
12.1 Governing Law. These Terms and Conditions are governed by and construed in accordance with the laws of the State of Maryland, United States of America, without regard to its conflict of law provisions.
12.2 Maryland-Specific Statutes Applicable to This Agreement:
- Maryland Consumer Protection Act (MCPA), Md. Code, Com. Law § 13-101 et seq. — prohibits unfair or deceptive trade practices; nothing in these Terms waives any rights guaranteed to Maryland consumers under the MCPA.
- Maryland Online Data Privacy Act (MODPA), Md. Code, Com. Law § 14-4601 et seq. (effective October 1, 2025) — governs the processing of personal data of Maryland consumers; see the Privacy Policy for full MODPA rights and disclosures.
- Maryland Personal Information Protection Act (MPIPA), Md. Code, Com. Law § 14-3501 et seq. — governs the safeguarding of personal information and breach notification obligations; in the event of a qualifying security breach, affected Maryland residents will be notified no later than 45 days after discovery, as required by Maryland law.
- Maryland Uniform Electronic Transactions Act (MUETA), Md. Code, Com. Law § 21-101 et seq. — electronic signatures and contracts formed via this website are legally binding under Maryland law.
- Maryland UCC / Digital Goods Principles — custom digital song files delivered in MP3 and WAV format constitute digital goods under Maryland commercial law. Title and risk of loss pass to the Customer upon confirmed electronic delivery to the Customer's provided email address.
12.3 Venue. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Montgomery County, Maryland, and both parties consent to the personal jurisdiction of those courts.
12.4 International E-Commerce Jurisdiction. Custom Songs For Life is an international digital goods business operating from Potomac, Maryland, USA. By placing an order, international customers acknowledge that: (a) the contract is formed under the laws of the State of Maryland, USA; (b) the E-SIGN Act governs electronic delivery and licensing of digital goods; (c) EU and UK customers retain rights under their mandatory consumer protection laws that cannot be overridden by this choice of law clause; (d) the UN Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded from governing this agreement; and (e) all disputes involving non-consumer international customers shall be resolved under Maryland law in Montgomery County courts or via AAA arbitration.
12.5 Informal Resolution First. Before initiating any formal dispute resolution proceedings, you agree to contact us at [email protected] and make a good-faith effort to resolve the dispute informally, allowing 30 days for resolution. We will endeavor to respond within 14 calendar days.
12.6 Binding Arbitration. If informal resolution is unsuccessful, all disputes, claims, or controversies arising out of or relating to these Terms or the services shall be finally resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in Montgomery County, Maryland, or remotely at the Customer's election. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
12.7 Class Action Waiver. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EACH PARTY WAIVES ITS RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All disputes must be brought in your individual capacity only.
12.8 Small Claims Exception. Notwithstanding the arbitration clause, either party may bring an individual claim in small claims court if the claim qualifies under that court's jurisdictional limits.
12.9 EU/UK Exception. EU and UK customers are not subject to the mandatory arbitration clause and may bring claims before their national courts or use the EU Online Dispute Resolution platform.
12.10 Time Limitation on Claims. Any claim arising under these Terms must be brought within one (1) year of the date the cause of action arose. Claims not brought within this period are permanently barred, to the maximum extent permitted by applicable law.
12.11 Nothing in this Section shall prevent either party from seeking emergency injunctive or equitable relief from a court of competent jurisdiction to preserve the status quo pending arbitration.
12A. Force Majeure
12A.1 Custom Songs For Life shall not be liable for any delay or failure to perform any obligation under these Terms to the extent that such delay or failure is caused by events beyond our reasonable control, including but not limited to: natural disasters, acts of God, pandemics, government actions or restrictions, cyberattacks, third-party service failures, fire, flood, or other force majeure events. In such circumstances, we will notify you as soon as reasonably practicable and make reasonable efforts to fulfill our obligations as soon as the circumstances permit.
13. Modifications to Terms
13.1 Custom Songs For Life reserves the right to update, amend, or replace these Terms at any time. When changes are made, the "Last Updated" date at the top of this policy will be revised accordingly.
13.2 Where changes are material, we will make reasonable efforts to notify Customers by email or by prominently posting a notice on the Site.
13.3 Your continued use of the Site or placement of an order following any modification to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Site.
